Hello:

Would you please pray for my wife? She has a service dog to aid her with her disability but her employer has denied her access to her job if she brings him with her. I can't say much more about the issue at this point due to the fact it has been turned over to the EEOC and is in legal process. Thanks.

It sounds very much like a fundamental violation of the Americans With Disabilities Act, unless her employer can show why allowing her to have her dog is not a "reasonable accommodation".

Hi Stuart:

It is a violation. They have offered her their reasonable accommodation which entails her having to ask for help from the staff. This certainly impinges on her independence and from what I understand, if she has a service dog they have to accommodate her by allowing the dog. She does not work in a doctors office or any other place that would preclude the use of a service animal. I have been told that the EEOC would not take on the case unless she had a valid complaint. We shall have to wait and see how this all pans out but it is aggravating too no end especially seeing as I trained him myself for the task not to mention the fact that he passed the AKC K9 good citizens test with flying colours the first time out. And to add insult to injury, he is registered with the state as a service dog, not something they give out lightly. Thank you for your prayers.

Prayers for a quick and painless resolution. Perhaps the employer is simply not aware of the requirements of the law and the EEOC can educate them and end this problem quickly.

If in the US, no employer may bar a service animal, unless the animal itself is a health risk for another employee.

Get a good disability lawyer...
